This document outlines the Terms and Conditions ('Terms') of the AI Photo Editing and Design App (the “App”). Please read these Terms carefully before using the App.
By using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.
Section 1. User Account
Any content that you submit to the App, including but not limited to photos, designs, images, videos, text, audio and any other content, are the sole responsibility of the person from whom such content originated. We assume no responsibility for any content posted by users of the App. You may not post content that is abusive, obscene, threatening, or illegal. We reserve the right, but not the obligation, to remove any content that we deem to be inappropriate or in violation of these Terms.
Section 2. User Content
In order to access certain content and features of the App, you may be required to register for an account. You agree to provide accurate, current and complete information about yourself as prompted by the App's registration form, and to maintain and update your information to keep it accurate, current and complete. You acknowledge that if any information provided by you is inaccurate, not current or incomplete, the App may terminate your account.
Section 3. Rights
You hereby grant the App a perpetual, non-exclusive, irrevocable, worldwide, royalty-free, sub-licensable, and transferable license to use, reproduce, distribute, modify, adapt, publish, translate, publicly display, and create derivative works from your content in connection with the App and its services.
Section 4. Disclaimer
The App is provided on an 'as is' and 'as available' basis. We make no warranty of any kind, express or implied, regarding the App or its services. You assume all responsibility and risk for your use of the App and its services. We disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Section 5. Limitation of Liability
We shall not be liable for any damages, including but not limited to direct, indirect, incidental, special, consequential, or punitive damages arising out of your use of the App or its services.
Section 6. Indemnification
You agree to indemnify, defend, and hold harmless the App, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from your use of the App or its services.
Section 7. Termination
We reserve the right to terminate or suspend your access to the App at any time and for any reason.
Section 8. Governing Law
These Terms shall be interpreted and governed by the laws of India.
These Terms constitute the entire agreement between you and the App and governs your use of the App, superseding any prior agreements between you and the App. The failure of the App to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of these Terms remain in full force and effect.
You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the use of the App or these Terms must be filed within one (1) year after such claim or cause of action arose or be forever barred. By using the App, you affirm that you have read and agree to these Terms.
